Train Your Dog, Lda is a dog training school intended for clients interested in acquiring the theoretical knowledge and practical skills they need to understand and effectively communicate with their dogs. Access to the services provided by the school presupposes knowledge and acceptance of this document and its content, referred to as “Terms and Conditions” and, additionally, the conditions of the Privacy Policy adopted by Train Your Dog, Lda. If you do not agree with the terms and conditions of this document, you should not use our services. These “Terms and Conditions” are subject to change at any time, and such changes are considered effective immediately after being revised and published on our website at the URL “https://www.trainyourdog.pt/”.

Clause 1.

Definitions:

For the purposes of these Terms and Conditions, Train Your Dog, Lda refers to the dog training school located at Rua de Barreiros, n.º66, 4715-166, Braga, a limited liability company with NIPC 517592193, here referred to as the school; client refers to the counterpart of these terms, becoming the client of the aforementioned school, and student refers to the client’s dog.

Clause 2.

Commencement and Term:

2.1 By these terms, the client gains the ability to use the school’s services under the conditions provided in the following clauses, by fulfilling their obligations, namely financial and attendance, among others.

2.2 These “Terms” commence on the date they are sent to the client, received through electronic address, printed, or any other means of information that allows the client to read and intends to contract the school’s services, accepting its contents, with the date of manifestation of will as the reference for the period the client is bound and when payments due by the client start to be owed. The client’s binding to the school will automatically end based on the type of classes chosen by the client, i.e., the period contracted with the school.

2.3 The school, except for exceptional unforeseen events, guarantees that the services provided will be executed with professionalism and efficiency.

Clause 3.

Services and Prices:

3.1 Services: The services provided by the school were requested by the client and were clearly, effectively, and thoroughly detailed by the school. The client can choose the modality that best suits their needs when contracting classes.

3.2 Access to class locations: It is always mandatory for the dog’s companion to use a leash, collar, or other means of restraining the dog when accessing the class locations.

3.3 Description of services:

3.3.1 – Mandatory Evaluation and individual class: To access the school’s services, the client must contract an initial class, called “Evaluation”, to assess the student’s real conditions. Based on the evaluation results, the school will present the client with the most suitable lesson plan for the student. If it is found that the student needs one or more individual classes to consolidate learning before starting group classes, these must be conducted as per prior scheduling and availability.

3.3.2 – Training packs: Subsequently, and based on the evaluation results, the client may choose (advised by the canine training professional) between private lessons or group lessons.

Private lessons are delivered in the form of a monthly “pack,” comprising a total of 4 (four) lessons, one lesson per week, within a maximum period of 40 (forty) days from the date of the first completed lesson.

Group lessons also operate in the form of a lesson “pack,” consisting of a total of 8 (eight) lessons, with one lesson being held per week consecutively on Saturdays at a previously defined and announced location.

If the trainer determines that other services are more suitable for the client than the previously stipulated training packs, they will inform the client of their specifics.

The specific details of each training plan are discussed during the evaluation or, in the case of its waiver, during the first training session with the trainer.

3.3.3 – Boarding: For dogs under 12 months of age, the client may opt for boarding training, where the animal receives obedience training while staying at the hotel.

Details, including items to be provided by the client, are agreed upon during the evaluation.

The minimum boarding duration is 30 days, with options to extend to 45 or 60 days. Clients must provide an updated vaccination record and sufficient food for the boarding period.

If the initial boarding period is set for 30 (thirty) days and the client wishes to extend it, the boarding may be renewed in 15 (fifteen)-day increments, subject to terms defined and agreed upon with the client. Payment for the extended boarding period must be made immediately upon agreement with the school.If the animal requires additional food or replacement materials during the boarding period, these costs will be charged to the client.

Should the animal require veterinary services during the boarding period, no travel fee will be charged; however, any expenses related to veterinary treatment will be the responsibility of the client.

3.3.4 – Sale of affiliates: The school offers products for sale, such as prongs, leashes, crates, among others, used in dog training, through affiliate links with Amazon. The school assumes no responsibility for any issues related to the quality, delivery, warranty, or any other aspect of the mentioned products.

3.4 Prices of Services:

3.4.1 – Evaluation and Individual Lesson: The evaluation prior to contracting each lesson pack costs €25 (twenty-five euros) and is conducted at fixed locations within the regular operating area of the school. Alternatively, the client can opt for it to be conducted at their home for a fee of €40 (forty euros). This fee may be subject to an additional travel charge as specified in point 3.7.1.1.

The individual lesson prior to integration into group lessons, when necessary, costs €50 (fifty euros).

3.4.2 – Lesson Packs: The school offers private lesson packs and group lesson packs. The prices for the lesson packs are communicated to the client prior to the evaluation, or if the evaluation does not take place, at the time of the evaluation.

The fee is paid in full at the first lesson, unless another payment method is agreed upon in advance, and the fee for the group lesson pack is due at the time of registration.

The pack of 4 (four) private lessons costs €180 (one hundred and eighty euros) if conducted at the fixed locations specified in point 3.7.2.

If conducted at the client’s home, the cost is €240 (two hundred and forty euros), provided the client’s residence is within the kilometers where the additional travel charge specified in point 3.7.3 does not apply. If applicable, an additional travel charge of €15 per lesson will apply if the client’s residence falls within the perimeter mentioned in point 3.7.3.

The group lesson pack costs €250 (two hundred and fifty euros).

If the trainer determines that other services are more suitable for the client than the previously stipulated training packs, they will inform the client of their specifics

3.4.3 – Boarding: The Zoom meeting costs €40, which will be deducted from the total boarding cost. The 30-day boarding service costs €1200, paid in full when the puppy is handed over to the trainer/school and is non-refundable. The 45-day (forty-five days) boarding period and the 60-day (sixty days) boarding period are priced at €1,800 (one thousand eight hundred euros) and €2,400 (two thousand four hundred euros), respectively. The full payment must be made at the time the animal is handed over to the trainer, and it is non-refundable.

In the event of an extension to the boarding period as outlined in section 3.3.3, the corresponding fee for the extended period must be paid immediately upon agreement with the school.

3.5 Community:

After successfully completing the classes, the client and the student may join the “Community” service by invitation. The Community service includes two monthly events, with dates and locations announced in advance. Joining the Community involves a €20 registration fee and a €25 monthly fee. The client is contacted for renewal of the monthly fee on the first business day of each month.

3.6 Support:

Clients receive support via WhatsApp, and a detailed training report is presented on the first business day after a session, outlining the training summary, exercises, and goals for the next class.

3.7 Areas of Operation and Travel Fees:

3.7.1. Travel fees:

3.7.1.1 Home Evaluation: A travel fee of €15 (five euros) may be applied to the home evaluation service if the client’s residence is located in the additional areas specified in clause 3.7.3.

3.7.1.2 Private Lessons: An additional travel fee of €15 (fifteen euros) per lesson may be applied to the cost of the private training pack if these are conducted at the client’s home, depending on the distance between the client’s residence and the school’s regular operating area. The client will be notified about the applicability of such a fee prior to the start of the training.

3.7.2 Points of Departure: For the purpose of calculating the school’s regular operating radius, the following points of departure are established:

In the city of Braga: Makro Braga store, located at Lugar da Arcela, Lamaçães, 4710-104 Braga;

In the city of Vila Nova de Famalicão: Casa das Artes, located at Av. Carlos Bacelar, Parque de Sinçães, 4760-103 Vila Nova de Famalicão;

In the city of Guimarães: training and evaluations are conducted at the fixed location of Playcare and Hotel at the Veterinary Hospital of Guimarães, located at R. Joaquim Ribeiro Mura 1104, 4835-015, Guimarães.

In the city of Porto: at Castelo do Queijo, located at Praça de Gonçalves Zarco 4100-274 Porto.

3.7.3 Regular Operating Radius: The school’s regular operating radius is determined as follows:

In the city of Braga, no additional travel fee is applied if the client’s residence is within a 5km radius from Makro Braga. The additional travel fee specified in point 3.7.1 is applied if the client’s residence is beyond 5km from the fixed location, up to a maximum distance of 10km.

In the city of Vila Nova de Famalicão, no additional travel fee is applied if the client’s residence is within a 5km radius from Casa das Artes. The additional travel fee specified in point 3.7.1 is applied if the client’s residence is beyond 5km from the fixed location, up to a maximum distance of 10km.

In the city of Guimarães, no additional travel fee is applied if the client’s residence is within a 5km radius of the Playcare and Hotel at the Veterinary Hospital of Guimarães. The additional travel fee outlined in section 3.7.1 applies if the client’s residence is located beyond 5km from the fixed location, up to a maximum distance of 10km.

In the city of Porto, no additional travel fee is applied if the client’s residence is within a 10km radius from Castelo do Queijo. The additional travel fee specified in point 3.7.1 is applied if the client’s residence is beyond 10km from the fixed location, up to a maximum distance of 15km.

3.7.4 Maximum Limits: In the cities of Braga, Guimarães and Famalicão, the maximum operating limit is set at 10km from the fixed points mentioned in 3.7.2. In the city of Porto, the maximum operating limit is set at 15km from the fixed points mentioned in 3.7.2. If the client’s residence is outside the maximum limits, the evaluation and private lessons will be conducted at the fixed locations or other agreed-upon locations.

3.8 Payment Methods:

All payments can be made by bank transfer, Mbway transfer, or in cash directly to the trainer. Payments should be made at the first class for individual classes or upon registration for group classes.

3.9 Renewal:

Clients wishing to continue classes after their contracted pack is exhausted can do so by acquiring a new pack according to the current price list at the time of renewal.

Clause 4:

Rescheduling and Cancellations:

4.1 Rescheduling by the client:

Once the first individual class is conducted, the remaining classes of the individual pack must be completed within 40 days, scheduled at the time of the first class. If the client informs the trainer of their inability to attend a scheduled class with at least 24 hours’ notice, the class can be rescheduled, subject to availability within the mentioned period. Rescheduling or cancellations made less than 24 hours in advance will result in the loss of the class, with no rescheduling or refund.

4.2 School Rescheduling:

If the trainer reschedules a private lesson more than 24 hours before the scheduled time, it will be rescheduled based on mutual availability. If the rescheduling by the trainer occurs less than 24 hours before the scheduled time, the school commits to offering an extra lesson. If the school fails to meet its obligations, the client may choose to be refunded for the value of the missed lessons, equal to their price.

4.3 Group Lesson Rescheduling:

The schedule, location, and trainer responsible for group lessons are determined by the school. If the client fails to attend the scheduled group lesson, it will not be rescheduled, and the lesson will be lost, to avoid disrupting the progress of other group members. If the lesson is not conducted due to a school-related reason, it will be rescheduled at an announced time and location as soon as possible without any additional charges.

4.4 Community Withdrawal:

If the client withdraws from the “Community” service, no refund is due for previously paid annual or monthly fees. If the client wishes to return to the community, a renewal fee of €20 (twenty euros) is due, regardless of the time elapsed between the end of the previous contract and the new one.

4.5 Cancellation:

Cancellation of lessons by the client, not covered by clause 4.1, requires the client to pay the remaining amounts owed at the time of cancellation, according to the current price list at the time of contracting.

Clause 5.

Rights and Obligations:

5.1 Cooperation:

The client must fulfill their obligations to attend scheduled lessons and pay for the contracted service on time. Failure to attend due to client reasons results in the lesson’s cancellation. The school cannot be held responsible for any facts solely attributable to the client resulting in non-fulfillment of their obligations.

5.2 Assignment:

The client cannot assign or transfer their contractual position under these terms to third parties.

5.3 Client’s Financial Obligation:

The payment amounts agreed upon when the client contracts the school’s services remain unchanged during the execution of their lessons, except for legally imposed changes, such as VAT rate alterations. The payment obligation is due as soon as the service is contracted, regardless of whether the client uses the service due to their sole responsibility.

5.4 Non-compliance:

In case of contractual non-compliance by the client, particularly concerning payment of the contracted service, the client cannot attend lessons and other school services until overdue obligations are settled. Non-compliance with payment obligations for more than X days results in automatic maturity of all remaining financial obligations, with the contract considered definitively breached, making the total amount due.

5.5 Forced Collection:

In case of forced collection of amounts owed by the client, in addition to the amounts referred to in the previous point, accrued interest at the legal rate in force, as well as all expenses incurred due to forced collection, such as court fees and Execution Agent and Lawyer fees, will be due.

Clause 6.

Client Responsibility:

6.1 Client Responsibility:

All clients must respect basic health and hygiene rules and education rules in dealing and interacting with other clients and school trainers. Clients are responsible for their dog’s behavior and well-being during training sessions. Any damage caused by a dog to other dogs, people, or property is the client’s responsibility. The client assumes full responsibility for their physical and mental fitness, as well as their pet’s abilities regarding the practice of exercises in classes; the client also assumes full responsibility for declaring the absence of contraindications to the exercises they will practice in classes; the client declares that neither they nor their pet suffer from any contagious diseases that could harm other clients or school trainers, assuming full responsibility for any damages caused to the school, clients, and third parties due to any disease or equivalent they suffer from.

6.2 Minor Students:

Attendance at classes by minors under 18 is only permitted when accompanied by an adult responsible for the minor and the pet.

6.3 School Liability Exclusion:

Under no circumstances will the school be responsible for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our services, nor for any losses or thefts occurring during classes.

Clause 7.

Intellectual Property:

All intellectual property rights related to the school’s services, including training materials and methodology, resources provided during classes, software, design, registered trademarks, and content, are the exclusive property of Train Your Dog, Lda and/or its licensors.

Clause 8.

Privacy Policy:

8.1 School Privacy Policy and Data Processing:

The school commits to observing the best practices in security, privacy, and protection of personal data recorded by users, adopting various techniques and organizational systems to ensure that the information provided enjoys an adequate level of security. The school’s services are available to the client and comply with the Privacy Policy, which can be consulted at https://www.trainyourdog.pt/politica-de-privacidade/ By accepting these terms and conditions, the client agrees to the Privacy Policy, which can be consulted at https://www.trainyourdog.pt/politica-de-privacidade/

8.2 Consent:

In the course of the school’s activities, due to the nature of the services provided, clients are required to provide a minimum and strictly necessary amount of information considered personal. The personal information provided is for the exclusive use of the school and for the purpose of filling out the client form.

8.2.1 Images:

During the school’s activities, in private and group classes, images and videos may be captured and shared on online platforms to promote services to third parties. Clients who do not wish to be filmed must inform the present trainer.

8.3 Confidential Information:

Each party guarantees that all information received from the other party, which by its nature is or should be considered confidential, will remain confidential unless legally required to disclose such information. The receiving party shall use confidential information only for the purposes for which it was provided. All information shall be considered confidential if classified as such by either party.

Clause 9.

Termination Terms:

The school reserves the right to terminate or suspend any client’s access to its services at any time, without prior notice and at its sole discretion, without refund, if the client’s or their dog’s behavior is deemed inappropriate or poses a danger to other clients, including dogs, people, or property.

Clause 10.

Applicable Law and Jurisdiction:

These Terms and Conditions are governed, interpreted, and enforced under the current Portuguese law. For resolving any disputes arising from the contract between the parties, the court with geographical jurisdiction for the school’s headquarters is competent, expressly waiving any other.

Acceptance and Binding:

The client of the services provided by the school is bound to accept and respect the terms and conditions expressed in this document. For any further clarification on the “Terms and Conditions,” please contact the Support team using the contact information provided. By contracting the school’s services, the client declares they have read, understood, and accepted the preceding terms.

Clause 1. Definitions
For the purposes of these Terms and Conditions, “Train Your Dog, Lda” refers to the dog training school with main office at Rua de Barreiros, no. 66, 4715-166 Braga, a limited liability company registered under NIPC 517592193, hereinafter referred to as the “school,” where its trainers and collaborators carry out their activities.
“Client” refers to the pet owner entering into this agreement.
“Accompanying person” refers to someone authorized by the client to drop off or pick up the animal.
“Animal” refers to the pet, i.e., the client’s dog and/or cat.
“Hospital” refers to the location where the services described herein are provided.

Clause 2. Commencement and Termination
2.1. By accepting these Terms, the client is granted the right to use the school’s services under the conditions set forth below, subject to fulfilling their obligations, particularly those related to payments and attendance.
2.2. These Terms take effect on the date the client expresses the intention to contract the service(s). They are made available to the client by email, print, website link, or any other accessible format. The client’s acceptance marks the start of their contractual obligation and payment responsibilities. Termination will depend on the type of services contracted.
2.3. The school guarantees that its services will be performed professionally and efficiently, notwithstanding potential unforeseen circumstances.

Clause 3. Services and Prices

3.1 Services
The services requested by the client are clearly, effectively, and thoroughly explained by the school. Upon service initiation, the client may choose the option that best fits their goals, subject to the initial evaluation as described in section 3.3.1.
Available services include: Dog Training School (individual and group sessions), Hotel, Playcare, and Bathing & Grooming.
Cats are only eligible for Hotel and Bathing & Grooming services—training and playcare services are not applicable to them.

3.2 Location and Access
Services are provided at the Playcare and Hotel facilities located in the Veterinary Hospital of Guimarães (Rua Joaquim Ribeiro Moura 1104, 4835-015 Guimarães, except for private training and evaluations conducted at the client’s home, as outlined in this agreement.

Use of a leash, collar, or other restraint is mandatory for access to the facility.

3.2.1 Home Location and Travel Radius
For purposes of determining the school’s regular operating radius, Guimarães is set as the starting point, specifically the Playcare and Hotel at R. Joaquim Ribeiro Moura 1104, 4835-015 Guimarães.
No travel fee applies if the client’s residence is within a 5 km radius of the HVG. For distances between 5 and 10 km, a €15 travel fee stipulated in 3.5.2. applies for at-home evaluations and training sessions.

3.3.1 – Mandatory Evaluation and Individual Lesson:

To access the school’s services for the first time, the client must schedule an initial session, called an “Evaluation,” during which the actual condition of the animal will be assessed. This requirement is waived only in cases where the animal has already undergone a similar evaluation by the school, or if the school expressly waives the need for one.

Based on the results of the “Evaluation,” the school will present the client with the services deemed most appropriate for the animal’s needs.

If it is determined that the animal requires one or more private lessons to consolidate learning after the evaluation, these must be scheduled in advance and subject to availability.

Whenever the trainer/staff member responsible for the service determines that a new evaluation is necessary due to behavioral changes, they will inform the client or the person accompanying the animal.

It is also possible for the evaluation to take place at the client’s home, according to the provisions set out in these terms.

3.3.2 – Grounds for Refusal:

The school reserves the right to refuse services to animals that, during or after the evaluation—or in its absence at any time—present, among other reasons (not limited to), illnesses, signs of contagious diseases, are in heat, or exhibit behaviors incompatible with the safe and appropriate provision of services.

As soon as exclusion grounds are identified, the school will inform the client/accompanying person that the animal is not eligible for services.

The school will also refuse to provide services if the animal does not have a microchip inserted and activated, if the client does not bring the vaccination booklet for the contracted service, or if the animal’s vaccines are outdated or invalid. This includes kennel cough vaccination and up-to-date internal and external deworming treatments.

3.3.3 – Special Cases:

3.3.3.1 – Brachycephalic Breeds

Brachycephalic breeds are those affected by brachycephalic respiratory syndrome, commonly experiencing issues such as stenotic nares, tracheal hypoplasia, elongated soft palate, laryngeal collapse, and hyperthermia, among others.
Breeds in this category include, but are not limited to: French Bulldog, English Bulldog, Pekingese, Lhasa Apso, Boston Terrier, Dogue de Bordeaux, Boxer, Maltese, Cavalier King Charles Spaniel, Shih Tzu, and Pug.

The school shall not be held responsible if, during service provision, an animal from one of these breeds suffers from any condition that requires veterinary intervention.

3.3.3.2 – Allergies

The school shall not be held responsible for any allergic reactions (to food products or other causes) suffered by an animal during services, especially if the allergy was not previously disclosed to the trainers or if it develops during the service.

3.3.3.3 – Dangerous Breeds and Potentially Dangerous Breeds

Animals classified by the Directorate-General for Food and Veterinary Affairs (DGAV) as potentially dangerous, or individually categorized as dangerous, may only access hotel and grooming services. Access to Play Care and Dog Training School is strictly prohibited.

An additional nightly fee applies to animals in these categories using the hotel service, as per the current price list, available at https://www.trainyourdog.pt/tabela-de-precos/. The fee accounts for use of a dedicated, individualized space and supervised leisure time requiring additional control.

These animals must also undergo the prior evaluation referred to in Clause 3.3.1.

3.4 – Description of Services:

3.4.1 – Training School:

The Training School refers to the provision of services related to dog training, which can range from basic obedience to the correction of behavioral problems in the animal.

Following the evaluation (unless exempted), first-time clients may choose—based on the recommendation of the professional dog trainer—one of three training formats: individual/private sessions, group sessions, or boarding training.

If the trainer determines that alternative training packages are better suited to the animal than those initially presented, the client will be informed of the specific details of these options.

The specifics of each training plan are discussed during the evaluation or, if the evaluation is waived, during the first training session with the trainer.

3.4.1.1 – Individual/Private Format:

Individualized training sessions involving the animal and the client. Private lessons are offered as a monthly “pack” comprising four (4) lessons, one per week, to be completed within a maximum of six (6) weeks from the date of the first session.

Private training sessions may also be conducted at the client’s home and may be subject to an additional travel fee, as stipulated in these terms and agreed with the client.

3.4.1.2 – Group Format:

Training provided in a group setting with other animals and clients. Offered as a “pack” of eight (8) lessons, one per week, at a schedule and time set by the school and previously communicated to the client.

3.4.1.3 – Boarding Training:

For animals under the age of 12 (twelve) months, and upon recommendation from the school’s professional trainer, the client may choose the boarding training service, which includes obedience training and accommodation at the facility.

All details, including the materials to be provided upon the animal’s drop-off, are arranged with the client during the prior evaluation.

The minimum boarding period is thirty (30) days. Clients may also choose extended periods of forty-five (45) or sixty (60) days.

For this service, the client must provide up-to-date vaccination records and sufficient dog food for the entire boarding period.

If the initial boarding period is thirty (30) days and the client wishes to extend it, the stay may be renewed in fifteen (15) day increments, under terms defined and agreed upon with the client. The cost of the extension must be paid immediately upon agreement.

If the animal runs out of food or requires replacement items during the stay, the related expenses will be charged to the client.

If veterinary services are needed during the boarding period, there will be no transportation fee. However, all veterinary treatment costs will be the client’s responsibility. Exclusively, the veterinary services will be provided by the associated hospital’s veterinarian.

3.4.2 – Hotel

The term “Hotel” refers to the provision of a service whereby, for a specific period previously agreed upon with the client, the animal stays overnight at the Play Care and Hospital Hotel facilities.

The provisions outlined in sections 3.3.2 and 3.3.3 also apply to the hotel service.

Hotel services are subject to prior booking, depending on availability. Upon booking, the client is informed of the total cost for the requested overnight stays.

Once the contracted stay period ends, if the client wishes to extend the animal’s stay, this is subject to availability. The client will be informed of the corresponding cost for the extended period, along with payment details, which must be settled immediately.

If the animal is in heat, hotel services are not permitted for the duration of that period, and any previously scheduled days must be rescheduled according to availability of both parties.

3.4.2.1 – Hotel Drop-off and Pick-up Hours:

Animals eligible for hotel services must be dropped off and picked up within the times established by the school, which follow Lisbon time.

The standard check-in and check-out times are provided in the service brochure and pricing table, sent to the client via the link: https://www.trainyourdog.pt/tabela-de-precos/

Standard check-in and check-out hours are from Monday to Saturday, 9:00 AM to 1:00 PM, subject to change.

Outside of the regular hours, check-ins and check-outs are not accepted. Exceptionally, and subject to a fixed extra fee of €15.00 (fifteen euros), late pick-up is permitted between 3:00 PM and 7:00 PM, payable at the time of pick-up unless another arrangement has been agreed upon in advance.

If the client fails to collect the animal within 24 hours of the scheduled pick-up date and does not contact the school or proceed with the pick-up, legal action may be initiated against the client.

3.4.3 – Play Care

“Play Care” refers to a service, previously contracted by the client, where the animal is placed under the care of the school’s staff and trainers for a portion of the day.

As a condition for accessing Play Care services, section 3.3.1 applies with regard to the initial evaluation.

The provisions of sections 3.3.1, 3.3.2, and 3.3.3 also apply to the Play Care service, particularly regarding grounds for exclusion.

If the animal is in heat, it is prohibited from using the Play Care service for the duration of that period, and any scheduled days will need to be rescheduled, subject to the availability of both parties.

3.4.3.1 – Service Types:

The Play Care service is available in single-use (daily), monthly, and day-pack formats, to be used by the expiration date communicated to the client.

The different monthly subscription types correspond to the frequency with which the animal attends Play Care.

The choice of day(s) in the monthly plan is fixed and must be made at the time of registration or renewal of the Play Care service, unless there is a lack of availability or open spots.

If the animal is not dropped off or picked up on a scheduled day, this day cannot be carried over to another week or month in the subscription.

3.4.3.1.1 – Quarterly, Semi-Annual, and Annual Packs:

If the client expects to use Play Care for an extended period, they may opt for a monthly plan through quarterly, semi-annual, or annual packs, based on prices and days agreed upon with the school.

3.4.3.2 – Schedule:

Animals eligible for Play Care must be dropped off and picked up within the times established by the school, according to Lisbon time.

The standard drop-off time is between 8:00 AM and 9:00 AM, and pick-up time is between 6:00 PM and 7:00 PM, from Monday to Friday, subject to change, which will be communicated to the client.

If, for reasons not attributable to the school, the client fails to pick up the animal on the agreed date and time, an extra fee equivalent to one Play Care day (€25.00) will be charged, due to the additional overnight stay.

If the client is absent for more than 24 hours beyond the expected pick-up time and does not communicate with the school or collect the animal, legal measures may be taken against the client.

3.4.4 – Baths and Grooming

“Baths and Grooming” refers to the provision of services related to bathing the animal, hair trimming, and general hygiene.

The use of the bath and grooming service is subject to prior booking, depending on available slots.

Payment for the grooming and bathing service is made at the time of reservation, upon drop-off, or at the moment of pick-up of the animal.

The Bath and Grooming service includes four options:

  • Bath only
  • Bath and clipper cut
  • Bath and scissor cut
  • Breed-specific cut
    For the last three options, the bath can be standard, therapeutic, or anti-flea.

The prices for each service option vary according to the size of the animal (small, medium, large, and giant) and the type of coat (short or long).

When making a booking, the drop-off and pick-up times must be strictly respected.

If the client fails to drop off the animal within ten minutes of the scheduled time, the service will not be provided.

If the client does not pick up the animal within one hour of the scheduled time, and does not notify the school of the delay or assign someone they trust to collect the animal, legal action may be taken against the client.

3.5 – Service Prices

3.5.1 – Payment Method:

All payments made by the client may be completed via bank transfer, Mbway transfer (according to the bank details provided), or in cash, handed directly to the trainer/staff member.

Payments related to the training school service must be made at the time of the first lesson in the case of individual sessions, or upon enrollment in the case of group classes.

3.5.2 – Preliminary Evaluation:

The preliminary evaluation required before contracting services, as stated in 3.3.1, is charged at the rate listed in the current price table, which is shared with the client when they express interest in scheduling the evaluation.

This price is also available via the link provided to the client (https://www.trainyourdog.pt/tabela-de-precos/) and on the school’s website.

If the client chooses to have the evaluation conducted at home, the corresponding fee is listed in the service brochure shared with the client and at the same link above. This fee may include an additional travel charge, depending on whether the client’s address falls within surcharge zones defined in clause 3.2.1.

3.5.3 – Training School:

3.5.3.1 – Preliminary Individual Lesson:

The initial individual session, as described in 3.3.1, when necessary, can take place at one of the fixed school locations listed in these terms or at the client’s home, as previously arranged.

  • The base cost is €45 if held at a fixed location.
  • If conducted at the client’s home, the cost is €60.
    These values are subject to change, with prior notice provided to the client and always reflected in the official price list.

3.5.3.2 – Lesson Packs:

The school offers packs of individual and group lessons. Prices for these lesson packs are communicated to the client before the preliminary evaluation, or, if this does not occur, at the time of the evaluation.

Prices are also posted at the hotel premises and published in the link provided in section 3.5.2.

If the individual lessons are to be conducted at the client’s home, a travel surcharge may apply, depending on the distance between the client’s residence and the school’s standard service area.

The client will be notified before training begins whether this surcharge is applicable.

  • The cost of individual lesson packs must be paid at the first session.
  • The cost of group lesson packs is payable at the time of enrollment.

The boarding service described in section 3.4.1.3, for a minimum period of 30 days, is also listed in the current price table, presented under the same terms.

The price for extended boarding periods of 45 or 60 days is likewise stated in the valid price table and is communicated to the client upon contracting the service.

This amount must be paid in full when the animal is delivered to the trainer/staff member and is non-refundable.

In the case of a boarding extension, as per section 3.4.1.3, the cost for the extended period must be paid immediately upon agreement with the school.

3.5.4 – Hotel:

The hotel stay rates are listed on the school’s website and are communicated to the client, along with a link to the current pricing. These prices are also posted at the hotel’s premises.

The final amount payable, corresponding to the number of nights booked, is provided to the client prior to the stay.

The hotel service also offers day packs, which can be used consecutively or intermittently, up to a date previously disclosed to the client.

Hotel nightly rates vary during peak season, defined as July 1st to August 31st.

Payment must be made in full at the time of the animal’s drop-off, or upon reservation confirmation.

If the client has two animals and wishes to use the same service for both during the same time period, a discount may apply for the second animal, depending on the current promotional campaign.

No refund will be given for unused days that were contracted for the hotel service if the cause is attributable to the client.

3.5.5 – Play Care:

The Play Care service is offered as single-day passes, monthly subscriptions, or day packs, the latter of which must be used entirely by a deadline previously communicated to the client.

and are also posted on the school’s website and in a visible location at the hotel.

Payment must be made prior to the animal’s attendance, or at the time of drop-off or pick-up, in the case of a renewal of the selected package.

Direct debit may also be used to pay for monthly subscriptions, according to bank details provided upon client request.

Quarterly, semi-annual, and annual packages may also be used, under terms agreed upon with the client at the time of contracting.

No refund will be given for days not used by the client for any of the selected play care service options, if the cause is attributable to the client.

If the client has two animals and wishes to use the same service for both at the same time, a discount may be applied for the second animal, depending on the current promotion.

If the animal is in heat, it is prohibited from using the Play Care service during that period. Scheduled days during this time are subject to rescheduling based on mutual availability.

3.5.6 – Baths and Grooming:

Bath and grooming service fees are based on the size of the animal (small, medium, large, giant) and coat length (short/long).

If the service includes a flea bath and/or therapeutic bath, an additional charge applies, as listed in the current pricing table.

Payment for this service is due in full at the time of booking, drop-off, or pick-up.

3.6 – Community:

After completing the private or group lessons described in these terms, and upon successful completion of training, the client and their animal may be invited by the trainer to join the “Community” service.

The “Community” involves two monthly events, the dates and times of which are determined and announced by the school in advance.

To join the “Community”, the animal must be registered, which involves payment of a registration fee of €20 (twenty euros) and a monthly fee of €25 (twenty-five euros).

On the first business day of each month, clients enrolled in the “Community” will be contacted regarding the renewal of their monthly subscription.

3.7 – Follow-up:

The client is offered follow-up via WhatsApp, and on the first business day after the training session, a detailed training report is provided. This report includes a summary of the session, exercises performed, and goals for the next lesson, in the case of private lessons, or a broader report, in the case of group training sessions.

3.8 – Renewal and Recontracting:

Clients who wish to renew services from the Training School or Play Care program may do so according to schedule availability, with the current pricing table applicable at the time of renewal.

If a client wishes to recontract any service from the Training School or Play Care, but more than two months have passed since the last use of the service, the animal may be subject to a new evaluation, under the same terms described in clause 3.1.1, to assess any behavioral or other changes that may affect the animal’s suitability for safe participation in the service(s).

Clause 4:

Cancellations and Rescheduling:

4.1 Cancellations by the client:

4.1.1 Private Lessons:
Once the client has contracted the private training service, the remaining sessions to be held within a maximum period of forty (40) days are scheduled during the first session.

If the client notifies the trainer of their inability to attend the scheduled private lesson at least 24 hours in advance, they will be entitled to reschedule it, subject to the availability of both parties and within the aforementioned period.

Cancellations or rescheduling made less than 24 hours before the scheduled date and time will result in the loss of the session, with no rescheduling or refund allowed.

4.1.2 Group Lessons:
The schedule, location, and trainer responsible for the group lessons are determined by the school.

Failure to attend a previously scheduled group lesson, for reasons attributable to the client, will result in no rescheduling and consequently the loss of the session, so as not to hinder the progress of the rest of the group.

If the scheduled lesson is not conducted due to reasons attributable to the school, it will be rescheduled at a location, date, and time announced to the clients as soon as possible, at no additional cost.

4.1.3 Hotel:
Cancellation of the contracted hotel service is only eligible for a refund if made at least thirty (30) days prior to the animal’s check-in. After this period, cancellations for reasons attributable to the client are not eligible for a refund.

The client has up to 24 hours before the scheduled single day or any day(s) booked as part of a day pack to cancel. Otherwise, the single day or day(s) from the pack will be forfeited without the possibility of rescheduling.

Booking days from the purchased pack is subject to the hotel’s availability.

In July and August, the purchase of day packs for use during those same months will not be permitted.

4.1.4 Play Care:
Cancellation of the play care service does not entitle the client to a refund for unused day(s), if the absence is attributable to the client.

The client has up to 24 hours before the scheduled single day or any day(s) booked as part of a day pack to cancel. Otherwise, the single day or day(s) from the pack will be forfeited without the possibility of rescheduling.

Booking days from the purchased pack is subject to the hotel’s availability.

In July and August, the purchase of day packs for use during those same months will not be permitted.

4.2 Cancellations by the school:
If the cancellation of grooming, hotel, or play care services is due to reasons attributable to the school, an appropriate refund will be issued, or in the case of daycare service, the affected day(s) may be rescheduled.

For the school’s training services (private and group lessons), sessions will be rescheduled according to the availability of the school and the client.

If the school fails to meet its obligations through its own fault, the client may choose to be reimbursed for the loss suffered, equal to the price of the lessons that were not provided.

4.3 Withdrawal from the Community:
In the event that a client enrolled in the “Community” service chooses to withdraw, no refund of the annual or monthly fee previously paid will be due.

If the client wishes to return and rejoin the community, no renewal fee will be charged, regardless of the time elapsed between the termination of the previous contract and the new enrollment.

4.4 Cancellation:
If the client cancels lessons outside the scope of Clause 4.1, they will be required to pay any remaining outstanding amounts at the time of cancellation, according to the pricing table in effect at the time of contracting.

Clause 5 Rights and Obligations:

5.1 Cooperation:
The client must fulfill their obligations by attending previously scheduled lessons and/or delivering and collecting the animal, as well as making timely payments for the contracted services.

The school cannot be held liable for any events solely attributable to the client that result in a failure to meet their obligations.

5.2 Assignment:
The client may not assign or transfer to third parties the contractual position arising from these terms.

5.3 Client’s Financial Obligation:
The payment amounts to which the client is bound are agreed upon at the time the client expresses intent to acquire the school’s services and remain valid throughout service provision. These amounts may be subject to change in accordance with the current price list and to adjustments required by law, such as changes to the applicable VAT rate. The client’s obligation to pay becomes due as soon as the service is contracted, regardless of whether or not the client makes use of it, when the reason lies solely with the client.

5.4 Breach of Contract:
In the event of a breach of contractual obligations by the client, particularly regarding payment for the contracted services, the client will not be allowed to use the services until all overdue obligations are settled. If the client fails to fulfill payment obligations for more than 24 hours, all remaining payment obligations will automatically become due, and the contract will be considered definitively breached, making the full amount immediately payable.

5.5 Enforced Collection:
In the case of enforced collection of amounts due, in addition to the aforementioned, the client will also owe any accrued interest at the legal rate in force, as well as all expenses incurred during the collection process, including court fees and the fees of enforcement agents and lawyers.

Clause 6 Client Responsibility:

6.1 Client Responsibility:
All clients are required to adhere to basic health and hygiene standards, as well as behave respectfully toward other clients and the school’s trainers.

Clients are responsible for the behavior and well-being of their dog during training sessions.

Any damage caused by an animal to other animals, people, or property is the client’s responsibility. The client assumes full responsibility for their own physical and mental fitness, as well as for that of their pet, with regard to participating in training, attending daycare, staying at the hotel, and grooming appointments, as applicable. The client also fully assumes responsibility for declaring that there are no contraindications to using the services they have contracted. The client declares that neither they nor their animal suffer from any contagious diseases that could pose a risk to other clients or trainers, and takes full responsibility for any harm caused to the school, other clients, or third parties due to any illness or similar condition.

6.2 Minors:
Minors under 18 years of age may only attend lessons when accompanied by an adult who is responsible for both the minor and the pet.

6.3 School’s Liability Disclaimer:
Under no circumstances shall the school be held liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use its services, and it is not responsible for any losses or thefts that may occur.

Clause 7 Intellectual Property:

All intellectual property rights related to the school’s services—including training materials and methodology, resources provided during lessons, software, design, registered trademarks, and content—are the exclusive property of Train Your Dog, Lda and/or its licensors.

Clause 8 Privacy Policy:

8.1 School’s Privacy Policy and Data Processing:
The school commits to adhering to best practices in security, privacy, and protection of users’ personal data, employing a range of technical and organizational measures to ensure an appropriate level of security for the information provided.

The school’s services comply with the Privacy Policy, which is available for consultation at: https://www.trainyourdog.pt/politica-deprivacidade/

By accepting these terms and conditions, the client also agrees to the Privacy Policy available at the link above.

8.2 Consent:
Due to the nature of the services provided, clients are required to provide only the minimum and strictly necessary personal information. The personal data collected is used exclusively by the school for the purpose of client registration.

8.2.1 Images:
During the provision of services, images and videos may be captured and shared online through digital platforms for promotional purposes.

If the client does not wish to appear in any recordings, they must inform the trainer present.

8.3 Confidential Information:
Each party guarantees that any information received from the other party that is or should reasonably be considered confidential must be kept confidential, unless disclosure is required by law. The recipient of such confidential information shall use it solely for the purposes for which it was provided. All information shall be considered confidential at any time if so classified by either party.

Clause 9 Termination Terms:

The school reserves the right to terminate or suspend any client’s access to its services at any time, without prior notice and at its sole discretion, without any refund, if the behavior of the client and/or their dog is deemed inappropriate or poses a danger to other clients, whether animals, people, or property.

Clause 10 Governing Law and Jurisdiction:

These Terms and Conditions are governed by, interpreted, and enforced in accordance with the applicable Portuguese law. For the resolution of any disputes arising from the contract between the parties, the court with jurisdiction over the municipality where the school is headquartered shall be competent, with express waiver of any other jurisdiction.

Acceptance and Binding Agreement:

By using the services provided by the school, the client agrees to and is bound by the terms and conditions stated in this document.
